Introduction

These Terms of Business (“Terms”) govern the relationship between Circadian Dynamics Ltd. (“Circadian Dynamics,” “we,” “us,” or “our”) and our customers (“you,” or “your”) who purchase our ECG and blood pressure trending index wellness report (“the Report”) that includes the use of the Faros monitoring device (“the Device”) and related cables (“the Cables”). By using our services and purchasing the Report, you agree to be bound by these Terms.

Service

Circadian Dynamics provides a wellness report based on ECG and blood pressure trending index. The Report is generated by the use of the Device and Cables, which are provided to you for the duration of the service. You agree to use the Device and Cables in accordance with the instructions provided and to promptly report any issues or defects. 

Fees and Payment

The fee for the Report is payable in advance and is specified on our website. The fee includes the use of the Device and Cables for the duration of the service. 

Ownership and Responsibility

The Device and Cables remain the property of Circadian Dynamics/ECG-OD and are provided to you for the duration of the service. You agree to take good care of the Device and Cables and to return them to us promptly at the end of the service. If the Device or Cables are lost or damaged during the service, you agree to pay Circadian Dynamics for the cost of replacing them.

Limitation of Liability

Circadian Dynamics will not be liable for any loss or damage caused by the use of the Device or Cables, except to the extent required by law. Circadian Dynamics will not be liable for any loss of data or other consequences arising from the use of the Report. You will be charged for the full cost of device or cables in the event that they are not retuned to ECG-OD. 

Termination

No refunds will be issued once the service has been ordered, even if you terminate the service before the end of the agreed term.

General

These Terms constitute the entire agreement between Circadian Dynamics and you and supersede any prior agreements or understandings, whether written or oral. These Terms may be amended by Circadian Dynamics from time to time and any amendments will be posted on our website. These Terms are governed by the laws of England and Wales and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
